SMS Messaging Terms & Conditions

These SMS Messaging Terms & Conditions ("SMS Terms") apply to text message communications sent by PoolServ LLC d/b/a Alligator Pool Services ("Alligator Pools," "we," "our," or "us") to customers and prospective customers who have opted in to receive SMS messages from us. By providing your mobile phone number and consenting to receive text messages, you agree to these SMS Terms.

2. Program Description

Alligator Pools is a Miami-Dade County pool service and renovation company. We use SMS text messaging to communicate with our customers for the following purposes:

Appointment confirmations, reminders, and scheduling updates
Service visit notifications and technician status updates (e.g., "on the way," "visit complete")
Estimates, invoices, and account-related information
Responses to questions or service requests you have submitted
Account security — one-time PINs for login verification
Promotional offers, seasonal specials, and service announcements (only where you have provided express written consent to receive marketing messages)

3. How to Opt In

You may opt in to receive SMS messages from Alligator Pools in any of the following ways:

Website form: By entering your mobile phone number on a form on our website and actively checking the SMS consent checkbox (the checkbox will not be pre-selected), you consent to receive text messages from us for the purposes described in the form.
Verbal consent: A team member may ask for your permission to send you text updates during a phone call or in-person interaction. You will receive a confirmation text after giving verbal consent.
Written consent: You may sign a paper consent form in connection with a service agreement or at our location.

After opting in via a web form or written method, you may receive a confirmation text similar to: "Thanks for subscribing to Alligator Pools text updates! Reply HELP for help or STOP to unsubscribe. You must respond to confirm your opt-in where we use a double opt-in process. If you do not confirm, you will not receive further messages.

4. Message Frequency

Message frequency varies depending on the nature of your service relationship with us. For appointment and service-related messages, you may receive one or more messages per scheduled service event. For promotional campaigns, message frequency will be disclosed at the time of opt-in. You will not receive messages more frequently than is reasonably necessary to support the services you have requested.

5. Message and Data Rates

Message and data rates may apply. Any charges for receiving or sending text messages are determined by your mobile carrier and your wireless plan. Alligator Pools does not charge any fees for SMS messages we send to you. If you have questions about your text or data plan, please contact your wireless carrier. Wireless carriers are not liable for delayed or undelivered messages.

6. How to Opt Out — STOP Instructions

You may opt out of receiving SMS messages from Alligator Pools at any time. To opt out:

Reply STOP to any text message you receive from us.

We also honor the following opt-out keywords: STOPALL, UNSUBSCRIBE, QUIT, CANCEL, and END.

After we receive your opt-out request, we will send you a one-time confirmation message acknowledging that you have been unsubscribed. Following that confirmation, you will not receive further SMS messages from us unless you choose to re-enroll. To re-enroll, you may sign up again through any of the opt-in methods described above.

Your consent to receive SMS messages from Alligator Pools is entirely voluntary. You are not required to provide your mobile phone number or agree to receive text messages in order to request or receive pool service, repairs, resurfacing, or any other services we offer. Declining to consent will not affect your ability to do business with us in any way.

9. Privacy and Data Use

We take the privacy of your mobile phone number and messaging data seriously. Your mobile phone number will be used only to communicate with you in accordance with the consent you have provided and these SMS Terms.

We will not sell, rent, lease, trade, or share your mobile phone number with third parties for their own marketing or promotional purposes.

We maintain records of your SMS consent, including the date, time, and method by which consent was obtained. We retain these records even after you opt out, in order to document your opt-out and to resolve any future disputes. Our SMS program is intended solely for communication between Alligator Pools and our customers or prospective customers. These SMS Terms do not authorize any other person or entity to send SMS messages on our behalf without express written permission.
